Brooke Tessmacher (Adams) is suing her former landlord, according to The Houston Chronicle. Adams filed suit claiming that she was wrongfully evicted due to her emotional support dog.
According to the suit, Adams Adams testified that she was suffering from postpartum depression and the loss of her father, and thus added the dog to the family. Adams and her fiance paid a pet deposit fee for a smaller dog (Noodles) in February, ten months before the emotional support dog (Waffles) was brought in. The owner and property manager then noticed Waffles in an Instagram post and, realizing he was not the same dog as the original on the agreement, said they had to pay an additional fee. According to Adams, they offered to pay the fee but the owner refused and gave two eviction notices. They left on New Year’s Eve, 2017 and a month later, the landlord demanded almost $14,000 for lost rent, lost attorney fees, and other charges connected to their leaving the house.
Adams says she believed it was her right to have the dog because “Under federal housing laws, landlords are required to provide reasonable accommodations to tenants with service and assistance animals, such as an emotional support dog. Guidelines from HUD say that tenants must make requests to their landlords for accommodations. Assistance and service animals are not considered pets under federal law, however.”
